End User License Agreement (EULA)

1. Agreement

This End User License Agreement ("EULA") is a legal agreement between you and Datana Studios LLC ("Datana Studios", "we", "us") for the use of our mobile applications (each, the "Application"). By installing or using any Datana Studios Application, you agree to this EULA. This EULA supplements our Terms of Service; if they conflict, the Terms of Service control except where this EULA is expressly required to control by an app store.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on devices you own or control, for personal, non-commercial purposes, subject to this EULA and the usage rules of the app store from which you obtained it.

3. Restrictions

You may not:

  • Copy, modify, or distribute the Application except as permitted by this EULA
  • Reverse engineer, decompile, or disassemble the Application, except to the extent such restriction is prohibited by law
  • Rent, lease, lend, sell, or sublicense the Application
  • Create derivative works of the Application
  • Remove any proprietary notices or labels on the Application

4. Intellectual Property

The Application and all copies thereof are proprietary to Datana Studios LLC and its licensors, and title and intellectual property rights remain with them. Content you create in the Application is yours, as described in the Terms of Service.

5. Subscriptions and Purchases

Certain features require payment. Purchases made through the Apple App Store or Google Play are subject to that store's terms; subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period, and can be managed in your device's store settings. Purchases made through our websites are governed by the payment terms in our Terms of Service.

6. Third-Party Services

The Application may integrate with third-party services, including AI model providers as described in our Privacy Policy. Your use of third-party services is subject to their terms.

7. Updates

We may release updates to the Application, which may install automatically. This EULA applies to all updates unless an update is accompanied by separate terms.

8. Termination

This EULA is effective until terminated. It terminates automatically if you fail to comply with its terms. Upon termination, you must cease all use of the Application and delete all copies. You may terminate at any time by deleting the Application and your account.

9. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

Our liability under this EULA is limited as set out in the Terms of Service: no indirect, incidental, special, or consequential damages, and total liability capped at the greater of $100 and the amounts you paid us in the prior 12 months, to the maximum extent permitted by law.

11. Governing Law

This EULA is governed by the laws of the State of New Jersey, and disputes are resolved as set out in the Terms of Service.

12. Apple App Store Terms

If you obtained the Application from the Apple App Store, the following additional terms apply:

  • Acknowledgment. This EULA is between you and Datana Studios LLC only, not with Apple Inc. ("Apple"). Apple is not responsible for the Application or its content. Your use of the Application must comply with the App Store Terms of Service.
  • Scope of license. The license granted is limited to a non-transferable license to use the Application on Apple-branded products that you own or control, as permitted by the Usage Rules in the App Store Terms of Service, except that the Application may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
  • Maintenance and support. We, not Apple, are solely responsible for providing any maintenance and support for the Application. Apple has no obligation to furnish any maintenance or support.
  • Warranty. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the Application to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Application; any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.
  • Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the Application, including (i) product liability claims, (ii) any claim that the Application fails to conform to legal or regulatory requirements, and (iii) claims arising under consumer protection, privacy, or similar legislation.
  • Intellectual property claims. In the event of any third-party claim that the Application or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of the claim.
  • Legal compliance. You represent and warrant that (i) you are not located in a country subject to a US Government embargo or designated a "terrorist supporting" country, and (ii) you are not listed on any US Government list of prohibited or restricted parties.
  • Developer contact. Questions, complaints, or claims regarding the Application should be directed to Datana Studios LLC, 971 US Highway 202N, Ste R, Branchburg, NJ 08876, USA, support@datana.ltd.
  • Third-party terms. You must comply with applicable third-party terms of agreement when using the Application.
  • Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
